This Article explores several meanings of a regulatory preference for government inaction. It explains the rise to dominance of this inaction preference in the United States and its distorting influence on the perception and understanding of regulation. Specifically, the Article demonstrates how basic terms in regulation, such as “government failure,” “regulatory capture,” and “deregulation,” acquired misleading connotations suggesting that government inaction is always superior to government action. The Article further explains how, through government inaction, the U.S. legal system accommodates rent (...) extraction - the profitable exploitation of market imperfections and favorable laws. Several developments in recent decades have considerably improved the capacity of very small groups in society to collect rents, namely, use talent and positional advantages to gain increasing levels of earnings. The Article argues that the parallel rise of the inaction preference has contributed to this trend, primarily because the availability of rent extraction opportunities draws talent that utilizes them with growing effectiveness. The purpose of the Article is to clarify several aspects of the relationships between regulation and rent extraction or, more precisely, to emphasize that government inaction may entail undesirable income effects. Research shows that the physician’s personal attributes and social characteristics have a strong association with their end-of-life decision making. Despite efforts to increase patient, family and surrogate input into EOL decision making, research shows the physician’s input to be dominant. Our research finds that physician’s social values, independent of religiosity, have a significant association with physician’s tendency to withhold or withdraw life sustaining, EOL treatments. It is suggested that physicians employ personal social values in their EOL medical coping, because they (...) have to cope with existential dilemmas posed by the mystery of death, and left unresolved by medical decision making mechanisms such as advanced directives and hospital ethics committees. This paper considers the African communal ethic of Ubuntu as it is understood in the South African context. Its background and context and the various interpretations of this lived ethic in society and academia will be explored. According to Ubuntu, what is good is constituted by how one relates to others (affirming others, empathising, etc.). It is not an ethic that is purely governed by laws and the outcomes of actions. This paper considers the detrimental effect of gangsterism on prisoners’ (...) personal and social development in South African prisons and illustrates how the solidarity and identity of prisoners is merely an illusion that misguidedly resembles communal harmony or Ubuntu. Specifically, after pointing out how indigenous values in South Africa tend to prescribe honouring harmonious relationships, this paper will reveal how this approach to morality affects the way one understands prison conditions, prison relations and criminal justice. It advances that the values of Ubuntu have the potential to aid in prisoner rehabilitation and help prisoners stand against gang life in prison. This paper will suggest that the harmony found in Ubuntu has implications different from gang conformity. Lacking the space to systematically defend harmony as a fundamental value, it nonetheless urges theorists not to disregard it when considering prison transformation in South Africa. The intention of this study is not to demonstrate that Ubuntu is superior to the more popular Western moral theories in South Africa, but rather to tease out the implications of one plausible interpretation of Ubuntu and apply it to prison communities in South Africa. This paper examines the perceived ethical values of Malaysian managers. It is based on the opinions of 15 hypothetical ethical/unethical business situations from the 81 managers who agreed to participate in the survey. The findings of this study showed that these Malaysian managers have high ethical values. However 53% of the respondents believed that the ethical standards of today are lower than that of 15 years ago. Apparently, this is related to the existence of many unethical business practices prevalent in (...) the modern business world. The behavior of one's immediate superior is the most important factor in influencing managers to commit unethical practices. The results also indicate only a slight variation among the managers in terms of perceived ethical values by virtue of job position, job specialization, type of business activity or the size of the business organization. IntroductionThe purpose of this essay is to work constructively with Michael S. Hogue's groundbreaking American Immanence: Democracy for an Uncertain World to demonstrate how psychodynamic analyses of religion are essential theoretical allies in the fight for resilient democracy. The "revolution in mind"1 that psychodynamic approaches contribute, especially in their analyses of religion, (...) both complements and complicates socio-political theory as a whole. In the improvisational spirit of "yes-and," the goal here is not to identify and decry the failures and shortcomings of Hogue's theopolitical vision but rather to inspire the recovery of a sibling discourse—a kind of "rebirth of a forgotten alternative"2—that also draws deeply from the American immanental tradition in order to add psychodynamic depth to Hogue's timely and important analysis. Psychodynamic theories of religion shed light on how symbolic identifications, including and especially ultimate concerns, structure personal and collective experience. By engaging religion and theology sympathetically, constructively, and creatively, theorists such as Rollo May, Gordon Allport, Karen Horney, Erich Fromm, and Ernest Becker departed from the skepticism, reductionism, and dismissal that characterized psychoanalytic analyses of religion in the wake of Freud.3 Each of these figures, and especially Becker whose work will be a focus in this essay, are noteworthy interlocutors for extending Hogue's theopolitical theorizing of resilient democracy, particularly in how they drew unique inspiration from the American immanental tradition [End Page 44] in their social analyses. In this respect, they provide a more robust theorization of the psychosocial conditions of the associational ethos needed to connect Hogue's conception of resilient democracy with forms of agonistic organization and democratic activism. Briefly stated, psychodynamic approaches are a helpful bridge for connecting these proposals to strategies of organization, their impediments, and collective action.In this way, both psychodynamic analyses of religion and Hogue's theopolitical innovation insist that no revolutionary political change is possible, and certainly not of the kind or scale needed to counter our wickedly entangled global crises, without a deep engagement with theological imaginaries. They differ, however, in their theoretical aims. Whereas Hogue compellingly argues for the political upshot of a theology deriving from the American immanental tradition, psychodynamic analysts of religion focus on the function of ultimate concerns in individual and collective life. In other words, American Immanence rests on a methodology of analyzing the philosophical and theological assumptions that have contributed to our climate crises and then presenting clear and compelling articulation of an alternative paradigm meant to open up new ways of being. In contrast psychodynamic analyses leverage conceptual clarity of psychic reality for the fundamentally therapeutic aim of transformation. At their best, both approaches share what could be called an etiological orientation to ontological questions in order to provide liberative alternatives through rational understanding and clarification, but the terrain, and thus the problems they hope to mitigate in their analyses are focused differently. Extending the visual metaphor, they are different lenses highlighting different areas of the same landscape. Furthermore, it must be said that neither are sufficient in themselves, but the psychodynamic theorists of religion to be highlighted in this essay share deeply with Hogue's heading in American Immanence.II. A Problematic AssumptionIn emphasizing and attempting to explain4 the role of non-rational processes in the both individual and social processes of perception and organization of experience, psychodynamic theories confound a widely held and problematic assumption that the triumph of rational analysis is the hallmark for building the society to which we should aspire. The article deals with the approach to understanding science and technology as well as natural and cultural practices developed by the American philosopher Karen Barad in the concept of agential realism. The peculiarity of her approach consists in referring as a starting point to quantum mechanics in its interpretation, which was proposed by Niels Bohr. Barad proposes a reinterpretation of Bohr's propositions through revealing their ontological content. In this regard, the article addresses the epistemological and ontological problems that quantum physics (...) has faced, such as the conditions for the possibility of an objective description of the world, the nature of measurement, and the relationship between language and the material world. Discussed is the shift that Barad argues is asserted in Bohr's philosophy-physics, which consists of quantum mechanics moving from the linguistic concepts in which the world of classical science was represented to what Barad calls material-discursive practices through which the world is articulated and explained. The possibilities of a different interpretation of Niels Bohr's philosophy-physics are considered. (shrink)

As ever more countries enter the global economy, reshaping the body has become the means by which women are encouraged to enter modernity. Once bodies were local, marked by their own local traditions. Today, variety is replaced by uniformity. The formerly plump Miss Nigeria is superseded by a thin westernized version and sets the trend for how contemporary Nigerian women are to look. Encouraged to see the body as a consuming center, a personal logo that signifies our membership of the (...) global community, bodies across the world are being commercialized and restructured. This development means that we are losing bodies as we lose mother tongue languages. The problem of human religious consciousness can be attributed to the category of "eternal" philosophical problems, which have never been removed and cannot be removed from the agenda of humanity. The world outlook of a person is updated throughout history as the person, conditions and content of his life, his goals, ideals and perspectives are constantly changing. In each era, this problem retains its fundamental importance, and, being part of all significant philosophical systems, means not a simple continuation of a (...) particular tradition, but the identification of the changing aspects and historical perspectives of human existence. The question of what consciousness, which is its nature and essence, is of great ideological, ideological and practical importance, since it touches upon the foundations of human existence, content and purpose of life. Purpose. To examine the existential anthropology of G. Marcel and E. Minkowski, in order to demonstrate the necessity of distinguishing the universal-spiritual, as human in human being, apart from the individual-existential in him, and to reveal the hierarchical correlation of biosocial, existential and spiritual spheres in personality. Theoretical basis. Within existential philosophy the author differentiates two separate traditions and proceeds from the insufficiency of the distinction of existential sphere, proposed by phenomenological tradition, showing the necessity of its correlation with the (...) spiritual sphere as a sphere of humanity, proposed by non-phenomenological tradition of G. Marcel and E. Minkowski. Originality. The author presents the anthropological conception of G. Marcel and E. Minkowski, in which human personality is understood as unity of individual-existential and universal-spiritual, which requires a special trans-empirical field of culture, which contains senses, images and symbols of humanity. Also, the author presents the recent developments of existential thinkers in distinguishing existential and spiritual dimensions, both not reducible to the physical and social dimensions. Conclusions. In both existential traditions, the specifically human was founded as a trans-biological and trans-social phenomenon, which appears as indefinable and non-predetermined. But in first tradition, humanity is understood as an existence, as a unique individuality, "project", variant of humanity, equivalent to other variants, and universal is understood as a community of human condition in the world. While in the second tradition, the universal is understood as spiritual. Thus, horizontal level of our private existence, as the process of movement from birth to death, is supplemented by vertical of human, universal ideals and images. Humanity appears as a task, on the way to which human being transcends beyond the limits of his individual "self" to the "super-individual", through inclusion into spiritual community, into universal culture.
